Raipur: The Chhattisgarh High Court has declared that unnatural sex between a man and his adult wife, without her consent, does not constitute an offense. According to reports, the court ruled that if the woman is over the age of 15, such an act cannot be classified as rape under Indian law.

The court’s judgment specifically stated that unnatural sex cannot be charged under Sections 376 and 377 of the Indian Penal Code. It also referenced amendments to Section 375 of the IPC, explaining that marital rape cannot be considered an offence due to conflicts between the relevant legal provisions.

This decision came in connection with a case where a woman died following an incident of unnatural sex. Medical reports revealed that the woman suffered from peritonitis and rectal perforation.

It is also significant to note that marital rape remains unpunishable in India. The issue is currently before the Supreme Court, which is set to hear petitions calling for the criminalization of marital rape. However, the Indian government has argued against such a move, emphasizing the importance of protecting the institution of marriage.

The ruling has sparked widespread debate and calls for legal reform in the country.
